Conditions of e-commerce sale by GioieChic

These General Conditions concern the purchase of jewellery and watches, made by means of the website www.gioiechic.com, belonging to
GioieChic S.a.s., registered office in Padova (PD) Corso Vittorio Emanuele II, no. 203, VAT no. and Tax No. 04295080289.

All purchases are subject to provisions under Italian Legislative Decree no. 185/99 and in relation to confidentiality, to provisions under Italian Law no. 675/96 and subsequent modifications.

Acceptance of the general conditions of sale

The offers made available on the site www.gioechic.com are exclusively tendered to adult purchasers.
The Client, in confirming the purchase order online, accepts unconditionally, and undertakes to abide in his relations with GioieChic S.r.l (hereinafter GioieChic), the general conditions and conditions for payment detailed below, declaring to have noted and accepted all information supplied under the above mentioned regulations, also acknowledging that GioieChic will not be bound by other conditions unless agreed in advance in writing.

Commitments by the client

* These General Conditions of Sale must be noted online by Client visitors to the site www.gioiechic.com prior to confirming their purchases. Submission of the order confirmation therefore implies full knowledge of these General Conditions of Sale and their complete acceptance.
* The Client undertakes and commits, on conclusion of the procedures for purchase online, to print and conserve these general conditions of sale, already noted and accepted during the purchasing process effected, in compliance with provisions under arts. 3 and 4 of Italian Legislative Decree no. 185/1999.

Prices

All prices of the GioieChic online offers are inclusive of VAT and valid only within the European Union.

Procedures for purchasing

* www.gioiechic.com is a website which offers visitors the opportunity to purchase watches, jewellery, objects in silver and gift articles.
* Purchases of the products, available as illustrated and described online in the descriptive and technical datasheets for the products, are made by the client at the price indicated, confirmed at the time of submission of the order confirmation, plus shipping fees as specified below and in any case shown at time of purchase.
* Prior to confirmation of the purchase the Client will be shown a summary of the unit price of every product chosen and the total cost in cases of purchase of several products the relative shipping fees.
* After confirming the purchase and completing the transaction, the Client will be sent an email detailing the data and total for the order.

Payments

Payment for the products purchased inclusive of the relative shipment expenses must be effected by the client at the time of confirmation of the order by means of one of the forms of payment available and indicated online, or by prior bank transfer.
* Payment by credit card We accept all principal credit cards. Payment by credit card is the most economic and convenient method. The transaction is made online using Paypal. We accept cards on the Visa and Master Card circuits, as well as PostePay. Data concerning the user is transmitted in encrypted form using the SSL system (Secure Socket Layer) directly to the Paypal servers which guarantee safety of data transmission in compliance with current banking procedures.
* Payment by bank transfer Payments may be made by bank transfer, effected by the client in advance of order confirmation, to the bank coordinates shown on the order confirmation. We cannot proceed with processing the order until payment is received, verified and cleared through the banking system.

Delivery of products

The products purchased will be delivered to the address indicated by the client. Every shipment will contain the goods ordered and the invoice document or cash receipt. Products will be delivered during all working days. Multiple purchases may be divided for delivery, without prejudice to GioieChic's responsibilities.
Only in the cases of products of a modest value will shipment be made using Poste Italiane, and then exclusively for recipients within Italian national territory.
In cases of loss or failure to deliver, GioieChic will be answerable exclusively for products shipped by private courier.
Prior to accepting delivery of the product, the client must verify that the package is intact, undamaged and dry, and that the sealing tape is intact and uncut.

Guarantee and defective products

*The products purchased through the site www.gioechic.com are subject, to the extent applicable, to provisions under Legislative Decree no. 24 of 2.2.2002 (Official Gazette no. 57, 8.3.2002) concerning contracts for sale and guarantees concerning consumer goods and, where not therein indicated, to the provisions in this regard under the Italian Civil Code. This guarantee shall apply to products presenting manufacturing defects and/or malfunctions undetected at the time of purchase, provided that the product has been used correctly and with due care, in keeping with its intended use and with any instructions attached, observing all recommendations therein indicated.
*The aforementioned guarantee shall not apply in cases of negligence, careless use, maintenance or cleaning of the product, or of any modification or tampering of the product. The guarantee is personal and shall therefore apply only to the original purchaser, being reserved to direct clients and not to retailers, dealers, etc.. It is the client's responsibility to fully complete and return to the manufacturer in the time indicated the certificates of guarantee, where applicable. In the absence of certificates the invoice or cash receipt may be used as proof of purchase. It should be conserved intact and legible (for safety also keep a photocopy).
*Any eventual malfunction of products must be communicated within ten (10) days from receipt of goods. The written notification must be attached by the client at the time of return of the defective product. The product, even if defective, to qualify for replacement, must at the time of return be complete with the packaging and all accessories and any documentation received by the client at time of purchase. Return of the product without the original packaging, accessories and any documentation, as described above, will result in GioieChic being unable to replace the product.
*Returns must be sent to the following address:

*GioieChic reserves the right to verify any defects claimed by the client and to replace the item only after such controls.
*Requests for replacement will be effected only if the returned package contains the following documents: number and date of order, brief description of the defect found, photocopy of invoice or cash receipt issued by GioieChic.
*Expenses for return of the goods to the sender shall be borne by the client.

Right of withdrawal

Purchases effected via the site www.gioiechic.com are regulated under Italian law on mail-order sales. If you have placed an order incorrectly and have received an unwanted article you have 10 days from date of delivery to exercise your right of withdrawal, i.e. to return the product. We shall unequivocally accept the return of any article, provided it is in perfect condition, reimbursing the full amount (excluding the cost of packaging and shipment, in accordance with Italian law).

Jurisdiction and court of arbitration

This Contract is regulated exclusively by Italian law. Any dispute concerning interpretation or execution of the contract will be settled by the Court of Padova.
